Several years ago, the plaintiff developed and patented a specially shaped toothbrush handle.
It follows from the published court decision that, in addition to the patent for the utility model “Toothbrush Handle,” the plaintiff owns exclusive rights to the design.
In 2021, the designer discovered that Planeta Zdorovya pharmacies were selling toothbrushes with a similar design.
He carried out a test purchase and then filed a lawsuit in court.
The court, having compared the materials presented by the plaintiff, decided to fully satisfy the plaintiff’s claim.
The defendant had to pay 50 thousand rubles for violating the copyright on the design of the toothbrush handle.
Apparently, the decision was not appealed and became final.
