A State Duma deputy spoke about whether a child in Russia has the right to sell an apartment.
It turned out that such a possibility exists if several conditions are met.
The Chairman of the State Duma Committee on Property, Land and Property Relations, Sergei Gavrilov, spoke about this in an interview with the NEWS.ru portal.
He recalled the legislation that exists in the Russian Federation and applies to minors.
Children aged 14 years already have the right to participate in real estate purchase and sale transactions, provided that their guardians or parents give permission for this.
The exception is the so-called emancipated children. Teenagers can receive this status from the age of 16 if they provide proof of their solvency.
These arguments include:
- availability of an employment contract;
- certificate of individual entrepreneurship;
- marriage certificate;
- registration in the Unified State Register of Individual Entrepreneurs.
It is noted that recognition of incapacity may become an obstacle to concluding a real estate sale transaction, so the corresponding verdict is issued by the court or guardianship authorities.
